Our collections, from Evergreen Collections to Christmas Ornaments, are carefully selected to inspire and thrive in your care.

We reserve the right to modify, suspend, or discontinue any part of the Site or services at any time without prior notice.

2. User Obligations and Account Responsibility

3. Product and Service Description

We strive to display our products, including Collector Plants, Full Sun Plants, and Artificial Christmas Trees, as accurately as possible. However, slight variations in colour, size, or exact appearance may occur due to monitor settings, natural variations in live plants, and handmade items. Product descriptions are not intended to be guarantees but rather our best representation at the time of listing.

Live Plants: We take utmost care in packaging live plants. However, they are living organisms and their health can be influenced by transit and subsequent care. Please refer to our Shipping & Returns Policy for specific conditions regarding plant sales.

4. Orders and Payment Terms

4.1 Order Process

Placing an item in your cart does not reserve it. An order is only confirmed once you complete checkout and we send an order confirmation email. We reserve the right to refuse or cancel any order for reasons including, but not limited to, product availability, errors in product or pricing information, or suspected fraudulent activity.

4.2 Pricing and Payment

All prices are listed in British Pounds Sterling (£) and include VAT where applicable. We reserve the right to adjust prices at any time, but changes will not affect confirmed orders.

We accept the following secure payment methods: Visa, MasterCard, JCB, and PayPal. Payment is deducted at the time of order confirmation. By providing payment information, you represent that you are authorised to use the chosen payment method.

4.3 Shipping and Delivery

Delivery is available to most global regions, excluding certain remote areas and parts of Asia as determined by our carriers.

• Processing: Orders are processed within 1-2 business days.
• Standard Shipping (£12.95): Via DHL/FedEx. Estimated delivery 10-15 business days after dispatch.
• Free Shipping: For orders over £50, shipped via EMS. Estimated delivery 15-25 business days after dispatch.

Delivery times are estimates. We are not liable for delays caused by customs, weather, carrier issues, or other unforeseen circumstances. Risk of loss and title for products pass to you upon delivery to the carrier.

5. Returns, Refunds, and Exchanges

Your satisfaction is paramount. Our detailed Returns & Exchanges Policy is incorporated into these Terms. Key points include:

• Return Window: 15 days from the date of delivery for eligible items.
• Non-Returnable Items: For health, safety, and perishability reasons, the following are final sale:
  • All live plants (Collector Plants, Full Sun Plants, etc.)
  • Fresh-cut Christmas Tree Collection
  • Opened or used garden supplies, soils, and plant care products.
• Condition: Returned items must be unused, in original packaging.
• Process: Returns require an RMA number obtained by contacting [email protected].
• Refunds: Issued to the original payment method within 7-10 business days after we receive and approve the return. Original shipping costs are non-refundable.

6. Intellectual Property

All content on this Site, including text, graphics, logos, images, product designs, and software, is the property of Fresh Plant World or its licensors and is protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our express written permission.

The “Fresh Plant World” name and logo, and all related product and service names, are our trademarks.

7. Limitation of Liability

Fresh Plant World and its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the Site or any products purchased through it.

Our total liability for any claim arising from your order shall not exceed the total amount you paid for the specific product(s) giving rise to the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability which cannot be excluded or limited under applicable law.
